The little show-off! Imagine how it must feel to open-out those lovely feathers. I was on hand with the 70-200mm f/4 to catch this moment. I thought of framing the bird closer then normal so focus in on the brilliant blue. On the post-processing side, I used a little Topaz Clean; it can make feathers and fur very dynamic. Personally I like to reduce the effect by applying a Gaussian blur to a duplicated layer.

They say that if you fall in love with avian photography you never go back; they have so much variety and life. A lifetime of chasing them, of gazing on their beauty; no camera can really portray such beauty.

Just a fun image that I've been meaning to upload for a while. I thought this Paphiopedilum Orchid looked a little like a laughing clown. Then my wife thought that the upper red petals looked to her like floppy dog's ears, like on the hats clowns sometimes wear.

I met Heather at the Run to the Sun Fashion Show in Anchorage, Alaska in April, 2009. We only had a brief opportunity to shoot back stage after the show. We talked about shooting with our group but things just fell through the cracks - so Heather, if you're still in town we would most definitely still love to shoot with you!

Charging Bull, which is sometimes referred to as the Wall Street Bull or the Bowling Green Bull, is a 3,200 kilograms (7,100 lb) bronze sculpture by Arturo Di Modica that stands in Bowling Green Park near Wall Street in Manhattan, New York City. Standing 11 feet (3.4 m) tall and measuring 16 feet (4.9 m) long,the oversize sculpture depicts a bull, the symbol of aggressive financial optimism and prosperity, leaning back on its haunches and with its head lowered as if ready to charge. The sculpture is both a popular tourist destination which draws thousands of people a day, as well as "one of the most iconic images of New York" and a "Wall Street icon" symbolizing "Wall Street" and the Financial District.

In Outdoor Monuments of Manhattan: A Historical Guide, Dianne Durante describes the sculpture:
The Bull's head is lowered, its nostrils flare, and its wickedly long, sharp horns are ready to gore; it's an angry, dangerous beast. The muscular body twists to one side, and the tail is curved like a lash: the Bull is also energetic and in motion.

The bronze color and hard, metallic texture of the sculpture's surface emphasises the brute force of the creature. The work was designed and placed so that viewers could walk around it, which also suggests the creature's own movement is unrestricted — a point reinforced by the twisting posture of the bull's body, according to Durante.

Charging Bull, then, shows an aggressive or even belligerent force on the move, but unpredictably. [...] [I]t's not far-fetched to say the theme is the energy, strength, and unpredictability of the stock market."

"That bull is one of an edition of five", Di Modica told the New York Daily News in 1998. "I'm hoping the other four will be going to cities all over the world, whenever somebody buys them." In 2010, a similar Charging Bull sculpted by Di Modica which looks "younger" and "stronger" was installed in Shanghai.

Thursday’s article, “Audit follows firing of Titusville EMS chief,” is just more proof in a long line of proof of how many unnecessary and useless layers of local government administration we’ve had forced upon us.

Titusville is a city of 45,000, so why would they even need an EMS/Training chief? The guy who was fired had a cushy, high-paying job and he still was either too lazy or incompetent to perform the few duties he had.

It makes us private citizens wonder how many of these type of people are hiding in our quagmire of local government and why we should be allowing them to collectively bargain against us and walk away with 60 percent of their salary as a pension.

I wish my dad hadn’t told me only lazy people work for the government because I would be rich and retired by now and have had a stress-free career.

Philadelphia - Old City: Franklin Court - B. Free Franklin Post Office

Franklin Court cuts through an entire city block on the former site of Benjamin Franklin's home at 316-322 Market Street. Although razed in 1812, a "Ghost House" frame, built by Robert Venturi in 1976 for the Bicentennial, depicts the exact positions of the original 3-story house, 33 square-foot, ten-room house and adjacent print shop, while excavations underneath reveal the original foundations, privy pits, and wells.

Six museums on the site, also built in 1976 for the Bicentennial, trace Franklin's life as a publisher, politician, postmaster, printer and invebtor. Below the court is an underground museum filled with paintings, objects, and inventions associated with Benjamin Franklin including a reproduction of Franklin's Armonica, also called a glass harmonica.

At 314 Market Street is the United States Postal Service Museum, with exhibits that include Pony Express pouches and originals of Franklin's Pennyslvania Gazette. At 316 Market Street is the B. Free Franklin Post Office, the the only active post office in the United States that does not fly a United States flag--because there wasn't yet one in 1775. At 318 Market Street is an architectural exhibit about Franklin's interest in fire-resistant buildings with fully exposed walls, revealing wooden joists separated by masonry and plaster. In the cellar are collections of pottery and glassware, collected from his privy pits. At 320 Market Street is the Printing Office and Bindery, with demonstrations of 18th century printing and binding equipment on display. At 322 Market Street is the General Advertiser, a the restored office of The Aurora and general Advertiser, the newspaper published by Franklin's grandson, Benjamin Franklin Bache. 322 Market Street also claims two famous connections--James Wilson, an editor of The Aurora, and grandfather to Woodrow Wilson, the 28th President of the United States, who lived there; and Sarah Josepha Hale, editor of Godey's Lady's Book and author of "Mary Had a Little Lamb," who worked there from 1837-1877.

Aloha Nephew. I hope you're reading this when you are older and can fully understand what I say to you now:

I really, really wanted to share this moment of You. Because you remind me so much of myself when I was a keiki: same coloring, similar hair, similar smile. Same soft spirit. In fact, I played on this very same soft, warm sand at Waimea Beach Park when I stood at your height! Your Gramma used to drive your mom, your Uncle Keo, and your Uncle Kalani halfway around the island in our dimpled, gray primer painted '63 VW Bug, beach chairs in tow (no air conditioning to blow), so we could frolic at just about the same spot you're pictured here, crouched and ready to fly high.

It was my favorite beach in all the world at a time when every beach was my favorite beach in all the world. And so that's why I wanted to post this photo of you, Nephew. But I also wanted it up little pup because it forever captures a special moment on the sweet-salty island home that raised me; and that now mothers you. Because that was an incredible, indelible moment you'll never remember. But I always will.

You were much too young to recall it, with every minute of everyday so full of specialness - - each moment to the next hardly standing out from the rest. But for grown up me, those kinds of moments have come fewer and farther. The distance between high and low, in the many seasons that now seem to just come and go.

Thus, the special times, fleeting or not, I cherish now more than ever. And so, Nephew, this moment From Above, I will never, ever forget. Because you were so free. So full of joy, so full of glee. And it reminded Me. It reminded me of what That was like. And what it should be like. And what it can still be like. And because it reminded me . . . of me . . . when I was you.

It doesn't matter that you will never remember it Nephew. I will. And for this moment from above, I'll always be grateful. More than you could ever know.

101 The Olmsted Vision: Parks, Playgrounds, and Beaches for the Los Angeles Region

The Los Angeles Times recently editorialized: "Los Angeles is chronically short of park space, a civic failure that generations of leaders have only glancingly addressed. In 1930, the brilliant but ignored Olmsted-Bartholomew plan envisioned a county where every resident enjoyed easy access to beaches, vistas, recreation areas and parks. Today, just 30% or so of Los Angeles' children live within walking distance of a public place to play, the lowest percentage of any major American city -- and the city is growing denser all the time."

The City Project's maps show the Olmsted proposal for parks, playgrounds, and beaches for the Los Angeles region, compared to the poverty of parks and beaches today.

In 1930, Olmsted Brothers and Bartholomew Associates published the classic report called "Parks, Playgrounds and Beaches for the Los Angeles Region." The Report proposed a comprehensive and coherent network of parks, playgrounds, schools, beaches, forests, and transportation to promote the social, economic, and environmental vitality of Los Angeles and the health of its people. The Olmsted firm was started by the sons of the great landscape architect Frederick Law Olmsted, who designed Central Park in New York City and founded the field of landscape architecture. According to the Olmsted-Bartholomew Report in words that remain true today:

"Continued prosperity [in Los Angeles] will depend on providing needed parks, because, with the growth of a great metropolis here, the absence of parks will make living conditions less and less attractive, less and less wholesome. . . . In so far, therefore, as the people fail to show the understanding, courage, and organizing ability necessary at this crisis, the growth of the Region will tend to strangle itself."

The report proposed:
*the shared use of parks and schools,
*greening the Los Angeles and San Gabriel Rivers,
*doubling beach access
*using parks and school fileds for clean water and flood control
*including forests in the park system
*transportation to parks, schools, rivers, beaches, mountains, and forests.

The Report recognized that low income communities should receive first consideration in parks and recreation because they often live in less desirable areas, and have fewer leisure opportunities. The Report recognized that a balanced park and recreation system serves diverse needs, including active and passive recreation. The Report recommended creating a regional park authority with power to raise funds to acquire and develop parks and other natural public places.

Each of these recommendations remains valid today.

Implementing the Olmsted vision would have made Los Angeles one of the most beautiful and livable regions in the world. Civic leaders killed the Report because of politics, bureaucracy, and greed in a triumph of private power over public space and social democracy.

Advocates and activists today are restoring a part of the vision and the lost beauty of Los Angeles through the urban park movement.

Hello everyone

The idea of this work accord to me when someone in another website suggest to me after seeing red rose girl photo that I should take another as a princess, and I said to myself why not ?!

So I had to come up with a special background and a help from here and there from the family to setup the drees ,the make-up and the gold accessories!

By the way , I took this shot two months ago and the reason why I just edited it two days ago because had to edit a lot before it and I gain more control on how to edit portraits.

The New York City Subway trails only the metro systems of Tokyo, Moscow and Seoul in annual ridership and carries more passengers than all other rail mass transit systems in the United States combined.

Subway stations are located throughout the New York City boroughs of Manhattan, Brooklyn, Queens, and the Bronx. All services pass through Manhattan, except for the Franklin Avenue Shuttle in Brooklyn, the Rockaway Park Shuttle in Queens, and the Brooklyn–Queens Crosstown Local connecting Brooklyn and Queens only. All but two of the 468 stations of the subway are served 24 hours a day. This is very rare globally; the only other United States rapid transit systems that share this distinction are the PATH (connecting northern New Jersey with Manhattan), the PATCO Speedline (linking Philadelphia with southern New Jersey), and two lines of the Chicago 'L'. "taipeitravel.net" is the official website developed by Department of Information and Tourism, Taipei City Government.

2009/6/18, one week after i wrote a complained email to Taipei City Mayor. The Dept. of Information and Tourism has admitted that its contractor; E-Century Information and Technology, has infringed my copyright by using my Taipei 101 fireworks NY2008 to merge with other photo to post on the front page of "taipeitravel.net" and The Department of Information and Tourism has aksed the contractor to be responsible for the consequences.

The supervisor (a.k.a. Creative Director) Cecilia Chang from E-Century Information and Technology, was trying to appeal to understanding that their designer was young and inexperienced not knowing what he did was worng and that Taipei Travel Net was a non-profit (please do not forget E-Century company makes profits) website...

2010/3/3, The verdict from Taipei District Prosecutors Office judged: in this criminal (copyright) law case, it (E-CENTURY INFORMATION & TECHNOLOGY CO.; the profitable contractor of Taipei City Government) is legal (has legitimate reasons *) to use my work for public purpose despite my declaration of "All rights reserved" and without my permission...

*according to government procurator's report, the major legitimate reasons incl:
fireworks are only small part on this front page, my works (fireworks shot) are not "originality" and taipeitravel.net is a non-profit website.

2010/4/16, receive a notice from Taiwan High Prosecutors Office that they have asked Taipei District Prosecutors Office continue investigation about this copyright law case.

(期間自2008/??/?? 開始,直到 2009/6/14 被我意外發現並通知台北市政府為止)。
儘管已經明白標示 "© 版權所有 不得轉載",檢察官仍然認為是"合理"使用...
這就是政府所謂"尊重智慧財產權,拒絕盜版"的真相嗎?

到底誰是"小偷"?
著作權是智慧財產權還是智慧"共產權" ?

透過朋友詢問臺北市政府觀光傳播局是否侵權使用本人煙火作品。

我email給臺北市政府市長信箱關於發現此事。

臺北市政府觀光傳播局觀光發展科黃科長下午招開協商會議,會議中承包商先得利資訊科技股份有限公司(E-Century)代表人兼創意總監張瓊月表示:
此「臺北旅遊網」係完全由該公司兩位年輕菜鳥設計師負責,伊事先並不知情,「臺北旅遊網」非商業網站,而他們一張網頁照片取得價格僅需新台幣數百元...等理由願意賠償本人。由於明顯規避侵權(著作權)責任,不提「臺北旅遊網」承包合約金額有數百萬元之多,不理本人所提以往授權之參考價格..等原因此未達成和解。

臺北市政府觀光傳播局局長 羊曉東回復我(發文字號北市觀發字09830610600號):
"「臺北旅遊網」首頁係本局97年經委託先得利資訊股份有限公司製做,該公司涉嫌未經您的同意即使用照片的行為,本局認為已損及 您及本局權益,並已依契約規定,另案函請該公司盡速妥為處理..."

我就著作權侵權事件請律師發存證信函, 正本先得利資訊股份有限公司代表人兼創意總監張瓊月, 副本臺北市政府觀光傳播局。

委請吳義雄律師向台北地方法院檢察署(以下簡稱地檢署)提告,就先得利資訊股份有限公司及創意總監張張瓊月與不詳姓名之其他設計師等人,有違反著作權法罪嫌提出刑事告訴。
2009/12/17
地檢署簽分秋股98年度字第11285號著作權法案件,開偵查庭。
2010/1/26
地檢署改簽分秋股99年度字第2106號著作權法案件,開偵查庭。
2010/2/10
地檢署 秋股99年度偵字第2106號著作權法案件,續開偵查庭。
檢察官楊冀華詢問證人"...質諸證人陳俞光到庭結稱: 伊為被告先得利公司之設計師,為製作臺北旅遊網歡迎頁經由雅虎奇摩網站搜尋引擎,在flickr網站發現若干煙火照片,伊僅取用煙火部份,乃將煙火部份一一拆下,翻轉後重製,過程為伊獨立完成,亦未報告被告張瓊月..."
註1: 陳姓設計師自稱是進入先得利公司未滿一年之菜鳥設計師,亦應是2009/6/12在觀光傳播局張瓊月向本人承認應對此事負責的兩位年輕設計師之ㄧ。
註2: 檢察官楊冀華在偵訊時表示,雙方律師可在7工作日內提出補充告訴理由狀說明。由於農曆新年假期,所以本人的委託律師於二月二十三日另提三頁補充說明。

檢察官楊冀華偵訊次日立即完成不起訴書,主要理由為:
一、證人陳姓設計師所取用之煙火部份質與量,佔臺北旅遊網歡迎頁之比例甚微。
二、次就利用結果對於著作之潛在市場與現在價值之影響言,告訴人前述「101煙火照片」其中煙火部份,單純忠實呈現煙火之型態,並無較為繁重之設計或技巧,告訴人亦自承修改之技術僅為影像重疊。而網路資訊發達,有關煙火照片俯拾即是,難謂有何特殊之無可取代性,此亦足以證明被告張瓊月或被告先得利公司其餘人員並無可能發現有何可使用上之爭議問題。
三、末就利用之目的及性質言,被告先得利公司並非直接販售上開之煙火照片圖利其為臺北市政府施作上揭網頁之最終目的仍係為推展城市觀光...

收到上述不起訴書,地檢署檢察官楊冀華做出的結論是:被告先得利公司係合理使用告訴人(本人)前述之「101煙火照片」...
2010/4/16
收到臺灣高等法院檢察署通知,將我申請再議之先得利資訊等 著作權法乙案發回續查。




註4:承包商先得利資訊科技股份有限公司 ,係從事廣告設計、智慧財產權等營業項目,資本額一千八百萬台幣,年營業額超過千萬,擁有台積電、寶鹼、行政院觀光局等知名客戶的一家"專業"公司。
註5:其實大家把作品放在flcikr供人瀏覽,就已經算是"分享"。請再進一歩參考,我所樂見"公益分享"的例子:
