The New York City Subway trails only the metro systems of Tokyo, Moscow and Seoul in annual ridership and carries more passengers than all other rail mass transit systems in the United States combined.

Subway stations are located throughout the New York City boroughs of Manhattan, Brooklyn, Queens, and the Bronx. All services pass through Manhattan, except for the Franklin Avenue Shuttle in Brooklyn, the Rockaway Park Shuttle in Queens, and the Brooklyn–Queens Crosstown Local connecting Brooklyn and Queens only. All but two of the 468 stations of the subway are served 24 hours a day. This is very rare globally; the only other United States rapid transit systems that share this distinction are the PATH (connecting northern New Jersey with Manhattan), the PATCO Speedline (linking Philadelphia with southern New Jersey), and two lines of the Chicago 'L'. my work was stolen by www.taipeitravel.net/ (since 2008/??/?? until 2009/6/14).
"taipeitravel.net" is the official website developed by Department of Information and Tourism, Taipei City Government.

2009/6/18, one week after i wrote a complained email to Taipei City Mayor. The Dept. of Information and Tourism has admitted that its contractor; E-Century Information and Technology, has infringed my copyright by using my Taipei 101 fireworks NY2008 to merge with other photo to post on the front page of "taipeitravel.net" and The Department of Information and Tourism has aksed the contractor to be responsible for the consequences.

The supervisor (a.k.a. Creative Director) Cecilia Chang from E-Century Information and Technology, was trying to appeal to understanding that their designer was young and inexperienced not knowing what he did was worng and that Taipei Travel Net was a non-profit (please do not forget E-Century company makes profits) website...

2010/3/3, The verdict from Taipei District Prosecutors Office judged: in this criminal (copyright) law case, it (E-CENTURY INFORMATION & TECHNOLOGY CO.; the profitable contractor of Taipei City Government) is legal (has legitimate reasons *) to use my work for public purpose despite my declaration of "All rights reserved" and without my permission...

*according to government procurator's report, the major legitimate reasons incl:
fireworks are only small part on this front page, my works (fireworks shot) are not "originality" and taipeitravel.net is a non-profit website.

2010/4/16, receive a notice from Taiwan High Prosecutors Office that they have asked Taipei District Prosecutors Office continue investigation about this copyright law case.

我email給臺北市政府市長信箱關於發現此事。
2009/6/12
臺北市政府觀光傳播局觀光發展科黃科長下午招開協商會議,會議中承包商先得利資訊科技股份有限公司(E-Century)代表人兼創意總監張瓊月表示:
此「臺北旅遊網」係完全由該公司兩位年輕菜鳥設計師負責,伊事先並不知情,「臺北旅遊網」非商業網站,而他們一張網頁照片取得價格僅需新台幣數百元...等理由願意賠償本人。由於明顯規避侵權(著作權)責任,不提「臺北旅遊網」承包合約金額有數百萬元之多,不理本人所提以往授權之參考價格..等原因此未達成和解。

臺北市政府觀光傳播局局長 羊曉東回復我(發文字號北市觀發字09830610600號):
"「臺北旅遊網」首頁係本局97年經委託先得利資訊股份有限公司製做,該公司涉嫌未經您的同意即使用照片的行為,本局認為已損及 您及本局權益,並已依契約規定,另案函請該公司盡速妥為處理..."

委請吳義雄律師向台北地方法院檢察署(以下簡稱地檢署)提告,就先得利資訊股份有限公司及創意總監張張瓊月與不詳姓名之其他設計師等人,有違反著作權法罪嫌提出刑事告訴。

地檢署簽分秋股98年度字第11285號著作權法案件,開偵查庭。
2010/1/26
地檢署改簽分秋股99年度字第2106號著作權法案件,開偵查庭。

地檢署 秋股99年度偵字第2106號著作權法案件,續開偵查庭。
檢察官楊冀華詢問證人"...質諸證人陳俞光到庭結稱: 伊為被告先得利公司之設計師,為製作臺北旅遊網歡迎頁經由雅虎奇摩網站搜尋引擎,在flickr網站發現若干煙火照片,伊僅取用煙火部份,乃將煙火部份一一拆下,翻轉後重製,過程為伊獨立完成,亦未報告被告張瓊月..."
註1: 陳姓設計師自稱是進入先得利公司未滿一年之菜鳥設計師,亦應是2009/6/12在觀光傳播局張瓊月向本人承認應對此事負責的兩位年輕設計師之ㄧ。
註2: 檢察官楊冀華在偵訊時表示,雙方律師可在7工作日內提出補充告訴理由狀說明。由於農曆新年假期,所以本人的委託律師於二月二十三日另提三頁補充說明。

檢察官楊冀華偵訊次日立即完成不起訴書,主要理由為:
一、證人陳姓設計師所取用之煙火部份質與量,佔臺北旅遊網歡迎頁之比例甚微。
二、次就利用結果對於著作之潛在市場與現在價值之影響言,告訴人前述「101煙火照片」其中煙火部份,單純忠實呈現煙火之型態,並無較為繁重之設計或技巧,告訴人亦自承修改之技術僅為影像重疊。而網路資訊發達,有關煙火照片俯拾即是,難謂有何特殊之無可取代性,此亦足以證明被告張瓊月或被告先得利公司其餘人員並無可能發現有何可使用上之爭議問題。
三、末就利用之目的及性質言,被告先得利公司並非直接販售上開之煙火照片圖利其為臺北市政府施作上揭網頁之最終目的仍係為推展城市觀光...

收到上述不起訴書,地檢署檢察官楊冀華做出的結論是:被告先得利公司係合理使用告訴人(本人)前述之「101煙火照片」...
2010/4/16
收到臺灣高等法院檢察署通知,將我申請再議之先得利資訊等 著作權法乙案發回續查。




註4:承包商先得利資訊科技股份有限公司 ,係從事廣告設計、智慧財產權等營業項目,資本額一千八百萬台幣,年營業額超過千萬,擁有台積電、寶鹼、行政院觀光局等知名客戶的一家"專業"公司。

The gradual color shifting looks so much nicer on my computer than Flickr. Oh well.

I only used Lightroom to edit this. I don't like Photoshop much. Not to say I never use it and don't think it is a valuable tool, but whenever I see it in the EXIF data, I am always skeptical because anything can be fixed and manipulated. Photoshop is a great manipulation tool, however, for PHOTOGRAPHY, I'm never sure if photos edited using PS can be validated as "real" without seeing the original.

It states specifically on apple's website that all MacBook pros can drive the 30 inch Apple Cinema Display. Well, I beg to differ.

The above photo shows what happens when I connect the aforementioned expensive as hell pieces of equipment. I've probably wasted 3-6 hours on this already wiping ram, installing updates, arguing on the phone, even taking my laptop into the apple store. All they said was that it's a known issue and are working on a fix. Kiss my ass and gimme my money back.

*update:
After talking to Apple's technical support line [for 2.5 hours] the conclusion that this is a problem that has never been seen before, and no one knows what it is was reached. Great, just my luck that I get the freakish guinea pig technical problem.

*resolution:
The MBP came back. According to the little invoice that comes with it the technicians replaced the motherboard. It now operates properly with the monitor.

I have been going through a bunch of my old photos and ran across this photograph that I took back in 2005 with my first digital camera. It was a 3 megapixel Canon point & shoot. When I first 'discovered' the old image I liked the photograph, but was a bit concerned with it's lack of resolution. Then I had the thought of "Well, let's take it into Topaz Adjust and smooth it out a bit". Of course, it still does not have a lot of detail, (actually even less than before) but with the painterly effect, you don't really need the detail and you end up with what I would consider a very pleasing photograph. Your thoughts?

About the campaign

“On November 4th, 2008 Proposition 8 passed, amending the state Constitution to ban same-sex marriage.

In the wake of the defeat, there has been a groundswell of initiative from within the community at grassroots level. Seizing this opportunity, new political and protest organizations are forming almost daily. The NOH8 Campaign is a photo project & silent protest created by celebrity photographer Adam Bouska and partner Jeff Parshley in direct reponse to the passage of Proposition 8.

The campaign started with portraits of everyday Californians who support Marriage Equality and soon rose to celebrities, military personnel, brothers & sisters, law enforcement, lesbian mothers, directors, politicians, newlyweds, and more, Photos feature subjects with duct tape over their mouths symbolizing their voices not being heard and NOH8 painted on one cheek in protest. ”

My personal view

I have a number of gay friends and family members - some that have kids and are fabulous parents and I love them to bits and without apology.

Some people have stated that their issue is with the use of the word marriage, (rather than the demonstration of commitment itself), based on the belief the church own the concept. It seems that the exact origin of marriage may not be known.

What we do know is that marriage is a legal recognition of a partnership that defines certain roles and responsibilities for each partner within that context.

It appears some believe the origins of marriage may come from the concept of a business transaction that merges two families or the dowry concept rather than from a religious point of view. Most churches will not perform a same-sex ceremony as it is against their religious beliefs and in many cases are not asked to - many same-sex marriages involve civil services rather than religious ones.

I have tried to understand why people have such an issue with same-sex relationships/marriages and just haven't been able to work it out. I have issues with bullying, violence, abuse, war, etc but no issue at all with people demonstrating their love and commitment for one another.

I don't personally know the origin of marriage, nor to I care. I'm happy to stand up and support anyone who wants to demonstrate their love for one another with or without an official document.

While in Scotland we stayed at Balmoral, so spending some time at the Castle & surrounds seemed like an obvious way to spend a beautiful spring day in Scotland. (No, we didn't say in the castle. We stayed in a wonderful little guest house. You can see a photo of our place here.) The grounds are beautiful & the Castle itself is wonderfully un-pretentious. The estate is virtually self sufficient with the organic gardens providing all the vegetables & floral decorations.

I've done several post showing various photos of the Texas Capitol (here). This one is actually inside the Capitol looking down at the floor under the Rotunda. If you look closely, you will see the Texas DPS officers that keep an eye on things standing on the ground floor. To their credit, they have always pretty much left me alone while I photographed this beautiful building.

A German photographer is threatening to go to court after Unge Høyres membership paper used her photo for the cover page without her consent.
-I’m asking for back pay for the use and for breach of the copyright, and also for moral rights, say Mareen Fischinger from Düsseldorf.
Last Tuesday the German freelance photographer sent a letter to Unge Høyre in which she calls to their attention that one of her photos are being used illegally as cover illustration on their membership paper Xtra.
The edition in question came out in September last year, the number printed being 20.000. The theme of the issue as women, feminism, and liberalism, something the cover illustrates by the photo of a young woman, Mareen Fischingers sister Vivien.

The photographer was not asked
The picture was taken by Mareen Fischinger, who in august posted it on flickr.com – a website where people interested in photography can view and comment on each other’s photos. Only recently did she see the comment by a Norwegian flickr user who had seen the picture on the cover of Xtra – a use Fischinger had neither heard about, nor given permission to.
I followed it up at once, and found several cases of the photo being used in the website of Unge Høyre, says Fischinger.
Was the photo protected in any way, either technically of through a copyright warning?
The photo can only be downloaded by registered flickr-users and carries the copyright mark © All rights reserved next to it. In my flickr profile I even ask people to send me an email should they wish to use photos privately, something a lot of people do…

Demands 67.000 kroner
In the letter to Unge Høyre Fischinger demand a fee of €1240, and an additional fee of €2800 for breach of the copyright. She also demands a similar fee on behalf of her sister, something that puts the total demand at over 67000 kroner.
In addition she demand that Unge Høyre sign a paper stating that they will never use the photo again, with a penalty fee of €41000 should they ever break the contract.
I will take the issue to court if Editor Ida Mjelde doesn’t answer or follow my instructions, says Fischinger.
That her photo is used in a political relation is extra bad to her. –Not even a big agency would approve of the political message without reservation, so Unge Høyre must have thought they got around that hurdle quite easily, says Fischinger, who have experienced similar misuse earlier.
This is probably just one of many cases where my photos are used illegally, but this time it was accidently discovered. In a new world with superfast internet photos are spread more. Everyone has got access to them, but that doesn’t mean they shouldn’t be protected. I put my files on the internet for people to watch them, not for people to exploit them for their own profit, or spread their message says Fischinger.
The young photographer was recently used by international photo agency GettyImages, but stress that the photo in question has never been available any other place than flicr.com.

"The leader of The Pressphotograpers Union, Terje Bringedal, is reacting sharply to this case.
There is no doubt that this is pure theft. They must have fetched the photo off the internet. Even Unge Høyre must understand that this is theft, says Bringedal.
There are according to him a lot of people experiencing their photos on the internet being used without permission. He also belives that Fischinger has a good case, should it ever get that far.
-I don't know about anyone having to go to trial about this, because most of the thieves acknowledge the fact."

This is what the general secretary of Unge Høyre, Gunnar Kongsrud, said when BT contacted him Tuesday. By this time Xtra-editor Ida Mjelde asked that all questions be directed at him. According to Mjelde it is Unge Høyre Landsforbund who is responsible for the graphic design of the paper. However, on the content page in Xtra the following is stated: "The content is not edited by any part of Unge Høyre, but by an independent editorial staff." Short time after BT's inquiry the web edition of the paper in question was unavailable.
